1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Imbine Technologies ("Company", "we", "our", or "us"), governing your access to and use of the Rozmo mobile application (iOS/Android), the rozmo.in website, and associated comparison software services.

By downloading, installing, accessing, or using Rozmo, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

2. Nature of Service: Price Discovery & Aggregator Intermediary

Rozmo is an independent technology platform and search engine designed to assist consumers in discovering and comparing product availability, pricing, promotional discounts, and delivery estimates across various third-party quick-commerce and e-commerce platforms (including Zepto, Blinkit, Swiggy Instamart, BigBasket, DMart, Milkbasket, Flipkart Minutes, and Amazon).

3. Accuracy of Pricing, Stock & Delivery Information

Quick-commerce platforms employ dynamic, algorithmic pricing models with frequent updates based on local dark store inventory, delivery partner supply, traffic conditions, and weather surges.

While Rozmo uses advanced real-time synchronization to display accurate catalog mappings:

• Prices, discounts, coupons, delivery surcharges, and estimated time of arrival (ETA) displayed in Rozmo are indicative and subject to instantaneous changes by merchants.
• The final price and availability confirmed on the merchant's checkout screen at the exact moment of payment shall govern your transaction.
• Imbine Technologies shall not be held liable for discrepancies between listed prices on Rozmo and final merchant checkout totals.

4. User Eligibility & Account Obligations

To use Rozmo, you must be at least 18 years of age (or have the consent of a legal parent/guardian) and reside in India. When creating an account via mobile phone number / OTP authentication:

• You agree to provide accurate and current contact details.
• You are responsible for maintaining the security and confidentiality of your device and login verification codes.
• You agree not to use Rozmo for any unlawful purpose, commercial scraping, unauthorized automated indexing, or denial-of-service attacks.

5. Third-Party Trademarks & Fair Use Disclaimer

All brand names, product logos, platform trademarks (including Zepto, Blinkit, Swiggy Instamart, BigBasket, DMart, Milkbasket, Flipkart, Amazon, and product manufacturers like Amul, Fortune, Cadbury, etc.) are the registered trademarks of their respective owners.

Reference to any specific store, brand, or service on Rozmo is for informational, comparative, and nominative fair-use purposes only, and does not constitute or imply endorsement, affiliation, sponsorship, or recommendation by the respective trademark holders.

6. Intellectual Property Rights

All proprietary rights, title, and interest in and to the Rozmo mobile application, software code, algorithms, visual design, user interfaces, branding, and content (excluding third-party merchant marks) are the exclusive property of Imbine Technologies and are protected by applicable Indian and international copyright, common law, and intellectual property laws.

7. Limitation of Liability

To the maximum extent permitted by applicable Indian law (including the Information Technology Act, 2000 and the Consumer Protection Act, 2019):

• Rozmo is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
• Imbine Technologies, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of the app, merchant delivery delays, damaged goods, food quality issues, or payment gateway failures on third-party platforms.

8. Indemnification

You agree to defend, indemnify, and hold harmless Imbine Technologies, its officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) resulting from your violation of these Terms or your infringement of any third-party rights.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Rozmo application shall be subject to the exclusive jurisdiction of the competent courts situated in New Delhi, India.
